RULES FOR REGISTRATION


ARTICLE I - American Pinzgauer Association Herdbook

A. The American Pinzgauer Association (APA) will maintain a system for registering qualified pedigree Pinzgauer cattle. This will include receiving applications for registry and raw data pertaining to each animal; processing such data so the eligible applicant can have certification of such information; recording all data to enable storage and retrieval so animals may be transferred and data analyzed and summarized for the improvement of the breed.

B. An efficient recordation system ensuring accuracy and integrity will be the APA's primary aim to enable growth toward higher beef production standards.

ARTICLE II - Pedigree and Performance Registry Options

A. A breeder may elect to register his cattle with or without performance data.

ARTICLE III - Registry Qualifications

A. Eligibility - Any animals with Pinzgauer blood may be registered with the APA.

B. Up-Breeding

1. Any breed of cattle either purebred or grade may be bred up to Pinzgauer purebred status.
2. Percentage of Offspring: Percentage will be assigned and printed on the certificate.

C. Proof of Parentage - Domestic Pinzgauer cattle can be registered by completing all mandatory information on the APA approved and adopted application for registration.

1. To register animals of 50% or less Pinzgauer blood, the sire or dam must be registered in the APA.
2. To register animals higher than 50% Pinzgauer blood, both the dam and the sire must be registered in a recognized Herdbook.
3. Sufficient proof of parentage shall be filed with the APA on all Pinzgauer progeny resulting from embryo transplants. This should include statements from AI technician and/or transplant organization.

D. Age Requirements - All animals must be registered before 365 days of age to avoid over-age penalty. The APA may require proof of parentage for animals older the 540 days of age by blood type analysis.

E. Import Animals - Before animals can be registered from foreign and domestic herdbooks, the sire, dam (except foundation dam) and the animal must be registered in a Herdbook recognized by the APA or the International Pinzgauer Breeder's Association.

1. The original Certificate, properly endorsed, should be used as the Application for Registration in the APA. When proper fees are paid, a new owner, and a copy will be retained by the APA.

F. Performance Requirements - Additional requirements for animals registered in the APA Performance Registry:

1. Weaning weights must be recorded on bulls and heifers for the animals to be eligible for Performance Registry. Weaning weights should be taken between 160 and 250 days. Animals weighed outside these age ranges will be reported by the APA as irregular.

2. Yearling weights should be submitted to complete performance data. Yearling weights should be taken at least 160 days after weaning weight and should not be taken on any individual under 330 days. The average age for each sex management group should be at least 365 days when this weight is taken. Animals weighed outside this range from 330-440 days of age will be reported as irregular.

ARTICLE IV - DNA Requirements

A. The approved Serology laboratory is:

Applications for typing should be made via the APA registry office and not directly to Bovigen, Inc.
B. Sires to be used for AI must have a US blood type record on file at the above laboratory and the APA Registry office. Progeny of AI will not be registered unless sire has a blood type on record.
C. Sires and dams used in embryo transplant must have blood type on file at the above laboratory and the APA Registry office. Embryo offspring must have blood type on file at the above laboratory and APA Registry office.
D. Encouraging DNA Testing

ARTICLE V - Application for Registration

A. Mandatory Information - Application for registration must be typed or printed in ink on forms obtained from the APA. All applications must contain the following information:

1. Pedigree Registry and Performance Registry:

a. Name and address of applicant
b. APA assigned breeder number
c. APA assigned herd prefix
d. Animal tattoo number - 6 digit maximum
e. Dam's APA number or private herd tattoo, date of birth and breed for foundation cows.
f. Sire's APA number
g. Date of birth of animal
h. Sex of animal and animal's percentage of Pinzgauer
i. Name of animal (optional)
j. Calving ease code
k. Multiple birth code
l. Horned/polled code

2. Performance Registry requires this additional information:

a. Dam's year of birth
b. Birth weight (if not entered - a standard of 85 pounds will be used)
c. Actual weaning weight and date
d. Management code
e. Dam's weight (optional)
f. Actual yearling weight and date
g. Feeding group

B. Signature - Signature of the owner of the animal at the time of registration certifies that all the data on the application is true and correct to the best of his/her knowledge.

1. Cattle owned by any individual, corporation, partnership or firm can be registered only in the name of the membership issued.

C. Leasing Females - Leasing of females. If a Pinzgauer female is leased for breeding purposes, both the lessor and lessee shall sign forms prescribed by the APA allowing the lessee to sign Application for Registry or transfer for the owner. The lessee shall be considered the breeder and owner of all progeny born to the leased female until such time as the lessor and lessee shall file with the APA office written notice of termination of the lease. Lessor shall pay all lease fees.

ARTICLE VI - Herd Prefix and Tattoo

A. Members are assigned herd prefix tattoo letters of any combination from two to four letters and/or numbers. This will be unique tattoo; in the event of duplicate requests, the number '2' will be assigned to the second request, etc.:

TPR1 - Texas Pinzgauer Ranch
TPR2 - Tom's Pinzgauer Ranch
TPR3 - Ted P. Reynolds

B. Any five numbers or letters and one additional letter tattoo character 3/8" or larger must be inserted in either ear of each Pinzgauer progeny before a registration certificate can be issued. The last character of the tattoo must be the international letter denoting the calander year of birth as follows:

J-1999, K-2000, L-2001, M-2002, N-2003, etc.
'I', 'O', 'Q', and 'V' are not used
Tattoo should be unique within the herd.

ARTICLE VII - Names of Animals

A. The names of the animals being registered should not be more than twenty-four (24) letters, numbers and/or spaces. This also includes prefixes, dashes or slashes. Tattoo number may be used as part of the animal's name.
B. Name change:

1. Names of imported animals may be changed at time of registry in APA.
2. The name of a registered animal may be changed upon written application to the APA, provided that the registration certificate is returned, the name desired is not already in use, and the proper fee is paid. The current name and the immediate previously-recorded name shall be printed on the registration certificate.
3. An unnamed animal may be named upon written application to the APA, provided that the registration certificate is returned, the name desired is not already in use and the proper fee is paid.

ARTICLE VIII - Multiple Births

A. When applying for registration to twins, or one number of twins, the word 'twin' must be written following the animal's name on the Application for Registration and the sex of the other twin must be given. Unless this is done, no application for registration of the other twin will be accepted. In births of twins, multiple births, a separate Application for Registration must be submitted for each animal. The word 'twin' or whatever multiple birth should appear on each certificate.
B. In the case of twins of opposite sex, the female cannot be registered until proven a breeder, at which time the extra fee for age shall be waived.

ARTICLE IX - Expunging Records

A. If, after registry of an animal in the herdbook, anything shall be learned which raises doubt as to the propriety or such registration, the Registry Secretary may cause the matter to be investigated and shall have the authority to suspend such registration pending said investigation. If, upon due hearing of the Executive Committee, it shall be found that an animal is improperly registered, the Executive Committee shall cause the registry to be expunged and take such other steps or measurers as the nature of the case in their judgment may require, subject, however, to an appeal o the Board either by the owner of said animal, or by any person financially interested in maintaining its registry, or by any two members of the Board itself under grievance procedures similar to that provided in the Bylaws. (Article VIII).
B. Where parentage is questioned by the APA, blood type analysis may be required and the APA will stand the cost. In other cases, the breeder will pay the blood typing fee. Blood typing must be processed at the serology laboratory approved by the APA Board of Directors

ARTICLE X - Erroneous Entry

A. Should any animal be admitted to entry or transferred through error, misrepresentation or fraud, the Registry Secretary on discovery of same shall declare the entry or transfer void, together with any entries that may have been made of descendents of such animal. When an animal shall have been transferred or entered through misrepresentation or fraud, the Executive Committee may direct the Registry Secretary to refuse for record any subsequent entry or transfer dependent upon the signature of any person implicated in such fraudulent entry or transfer.
B. Notwithstanding anything herein contained, the APA assumes no responsibility, financial or otherwise, for any loss or damage that may be sustained by an individual, partnership, firm, or corporation by and reason of suspension, cancellation or correction of any registration, transfer or other documents.

ARTICLE XI - Pedigree

A. Members may file all data on breeding of their animals in the APA office. The APA shall furnish, for a fee, extended pedigrees as filed by the breeder, which will contain a statement to the effect that this is the pedigree furnished by the breeder and is not certified correct by the APA. No responsibility shall rest on the APA by reasons of misrepresentations by the breeder.

ARTICLE XII - Duplicate/Copy Certificates

A. In the event that a certificate has been lost or destroyed, a duplicate certificate can be obtained by submitting an affidavit containing all necessary information. If the original certificate is found, it will become the property of the APA, and must be returned to the APA registry office.
B. Photo static copies of original certificates may be obtained from the Association upon request. A charge will be made per the current fee schedule and the words 'copy not negotiable' will be printed on the reproduction.

ARTICLE XIII - Correction of Certificate

A. When new certificates are received from the APA, they should be checked immediately to determine if correct. If an error is found or correction found necessary, it should be returned to the APA office for correction. If the error is that of the applicant, the applicant will pay the correction fee. If the error was caused by the APA office, the correction will be made at no charge. Any writing on the certificate not made by the APA office will invalidate the certificate and necessitate the issuance of a duplicate at a cost to the holder of the regular fee.

ARTICLE XIV - Breeder's Records

A. Upon death of a registered animal, it is the responsibility of the owner to report the deceased animal to the APA for cancellation of registration certificate.
B. Owners and breeders of Pinzgauer cattle should keep accurate, complete records on dates of service or insemination, name and registration number of animals bred, and APA number of sires used, date of calving, sex and identification of offspring. Such information is required to prove data submitted on application for registration.

ARTICLE XV - Transfer of Animals

A. Every change of ownership of a registered animal must be entered as a transfer with the APA.
B. Applications for transfer shall be signed by the seller and submitted to the APA for processing. Every application for transfer of an animal shall be taken as a guarantee of the owner that the animal is as represented and that all maters in the application are true.
C. The Registry Secretary of the APA may sign transfers and other forms as agent of the owner.
D. Sale managers are authorized to sign transfers (not registration applications) as agents of the owner if they print the owner's name on the transferor's line, print the sale management firm, sign the transfer personally and list the sale involved and its date.
E. The transfer application must give the printed name and address of the new owner and the date of the sale.
F. The transfer application may have two forms:

1. Transfer of a registered Pinzgauer:
The transfer application is on the registration certificate.
2. Transfer of an animal at the time of registration:
All registration forms now allow for animals o be transferred at the time they are registered.

G. Application for transfer of a registered female: The application must include whether animal is bred or open. If bred, the application must contain he service dates, APA number of sire and the dates of any pasture exposure. This data will allow the new owner to register the resulting progeny in his name and will list the seller as the breeder.
H. Application for transfer of a registered female with calf at side: The application must include the information in G above plus the calf's birth date, Herd Prefix, tattoo number, sex and the sire's APA number. This will allow the new owner to register the calf and list the seller as the breeder. Breeder is responsible for registration of a calf sold at side or provide a completed application for registration to buyer with agreement between both parties that buyer will pay for said registration.
I. An application for transfer must specify to whom the registration certificate is to be sent after transfer is properly recorded in the APA. If not specified, the transferred certificate will be sent to the buyer.
J. A transfer of registration entered on an application or certificate f registration or on the records of the Association shall not be construed as the conveyance of legal title by the Association. The Association shall in no way be involved in or assume liability for the purchase, sale or terms of a sale of registered animals or the passage of legal title thereto.

ARTICLE XVI - Fees

A. The APA is on a cash basis. Registration fees are based on date of postmark, indicating date mailed by applicant. Transfer and lease fees are based on the date of sale or lease. If the correct fee does not accompany the application or prior payment has not been made, the sender is notified of the unpaid balance. No applications are processed until each transaction is paid in full.
B. Non-members, Associate and Honorary Members may register Pinzgauer cattle, but the cost will be two times the fee charged to active members. This rule shall be prominently displayed on any published fee schedule.
C. It will be the policy of the APA that the seller will pay the registration and transfer fees (unless otherwise agreed to by both buyer and seller).
D. Fees may be changed a the discretion of the APA Board of Directors.

E. A.I. Certificate Program - This program is a service offered to Association members who wish to enroll their qualified sires. It is a voluntary and optional program, and certificates are only required to register calves out of enrolled bulls.

Fees on animals over 48 months of age will be subject to review by the acting Registry Secretary of the APA. The application must be signed by the original breeder except in the case of death or disability of the original breeder.

NOTE: Non-members, Associate and Honorary members may register Pinzgauer cattle, but the cost will be two times the fee charged to active members.

1. BIDDING: Each animal will be sold to the highest bidder without reserve and ownership will change when the animal is sold. The auctioneer will settle any disputes as to bids and may, at his discretion declare all bids off and resell the animal in question.

2. TERMS: Terms of this sale are CASH (US Funds) in all cases.

3. HANDLING: All animals will become the responsibility of the purchaser from the time declared sold in the ring.

4. BREEDING STATUS GLOSSARY:
SAFE IN CALF: female has been palpated and diagnosed pregnant by a licensed veterinarian.
BRED: Female has been served by a bull or artificially inseminated to a bull, but this does not mean this female is safe in calf to that service.
OPEN: This is (a) a virgin heifer that has never been exposed to a bull by any means; (b) in the case of a cow, she has not been exposed to a bull by any means since the birth of her last calf; (c) a female any age palpated by a veterinarian and found not to have conceived; (d) in the event a female is sold as "OPEN" and is later suspected to have been bred when purchased, the following will apply:

  1. The cow/heifer must be palpated by a licensed veterinarian to determine the length of the term of the calf.
  2. A copy of the diagnosis by the veterinarian, along with a letter in writing of the matter, must be sent to the seller by the buyer within 120 days of the purchased date.
  3. The diagnosis by the veterinarian will be the final determination of the term of the calf.
  4. It will be the responsibility of the seller to reimburse the buyer the cost of the examination by the veterinarian.
  5. In no event will the seller be responsible for more than the purchased price of the female and the cost of the examination by the veterinarian.

5. BREEDING GUARANTEE:
Females: Cows represented as being 'safe in calf' will have been examined and declared safe by a licensed veterinarian. They are considered breeders without further guarantee. Cows and heifers represented as bred are not guaranteed as 'safe in calf', BUT they, and open heifers selling as individual lots are guaranteed to be breeders. No guarantee shall apply to suckling calves. In the event a female is claimed to be a non-breeder and after having been bred regularly to a bull known to be a breeder and after having been treated by a licensed veterinarian, the matter must be reported within six (6) months of the sale date to the seller. Heifers over twelve (12) months of age who fail to conceive to the services of a bull known to be a breeder, and after having been treated by a licensed veterinarian the matter must be reported in writing to the seller before the heifer reaches eighteen (18) months of age. The seller shall have six (6) additional months in which to prove any such female a breeder and may use any registered bull of the female's breed available to him. Any female returned will be at the purchaser's risk. No guarantee is given that a pregnant female will deliver live calves or that she will carry the calves full term. In no event shall the seller be responsible for more than the purchase price. The seller is not responsible for damage caused by foreign bodies after the animal has been sold nor for sickness not apparent at sale time.
Bulls: Bulls over one year of age must be accompanied by a satisfactory Bull Soundness Evaluation (BSE) performed by a licensed veterinarian.

6. HEALTH: Each animal requiring Brucellosis and TB test in accordance with Federal Regulations will have been tested within 30 days prior to date of sale. A veterinarian will be available sale day to assist new owners with interstate health papers.

7. CLEAR TITLE: Each seller warrants clear title to the animals and the right to sell the same. Original APA Registration Certificate in sellers name will be required at sale time.

8. ANNOUNCEMENTS: AS catalogs must go to press a considerable time ahead of the sale, there will be announcements made relative to breeding dates, new calves, etc. Any and all announcements made from the auction block or from the ring - relative to the animal(s) selling, take precedence over the printed information in the catalog or sale supplements.

9. REGISTRATION AND TRANSFERS: Each anima is recorded in the herd book of the American Pinzgauer Association (APA). Applications for transfer will be forwarded to the Association when payment in full has been secured.

10. BUYERS RESPONSIBILITY: Prospective buyers or bidders at the sale should listen carefully to all announcements made from the auction block by the Auctioneer, Sale Manager, or Seller, on each animal that is sold since it is clearly stated elsewhere in these terms and conditions of sale that announcements from the auction block take precedence over the printed material in the sale catalog. Buyers should also acquaint themselves with the breeding status glossary defined in these terms and conditions. By doing so, a buyer can save himself many problems and it will enable him to be a more competent and qualified buyer.

11. MAIL BIDS: Mail or wire bids may be furnished in confidential form.

12. RIGHTS AND OBLIGATIONS: The above terms and conditions of sale shall constitute a contract between buyer and sell and be equally binding to both. Animals that are resold following purchase in this sale constitute a separate transaction, and the rights and obligations of the two parties connected thereto are not covered by these terms and conditions.

13. LIABILITIES: American Pinzgauer Association is acting as a medium only between the buyer and seller. The American Pinzgauer Association is not liable in any way whatsoever for any representations made by the seller. American Pinzgauer Association is not in any way liable for any failure on the part of the buyer and or the seller to live up to his/her obligations. The buyer must look to the seller for fulfillment of all representation made here under.

All persons who attend any portion of this event do so of heir own responsibility and risk. The seller, AMERICAN PINZGAUER ASSOCIATION, their principal, officers, managers, employees, assistants, auctioneers are without liability of any nature, legal or otherwise.

Sale cattle will be available for release immediately after the sale. All purchasers must make settlement with the sale management office and secure a release on the cattle purchased before cattle can be loaded out.


American Pinzgauer Association
National Show Rules and Classes

I. RULES

Regional associations must abide by all of the national show rules in order to host the National Show; with exceptions allowable only in the number of group classes offered.

1. All entries must be registered with the American Pinzgauer Association. All exhibitors must be members of the APA.
2. All entries must have legible tattoos that agree with their registration certificates and tattoos may be checked and verified by an official at the show on the day of arrival.
3. All entries must be purebred or fullblood Pinzgauer.
4. All entries must be red and solid faced, have a white underbelly and a predominately white tail.
5. All entries will be subject to sifting for correctness of papers and suitability to show.
6. Entries in the group classes must also show in an individual class.
7. Animals will enter the show ring in ascending order according to age, youngest to oldest.
8. Classes with fewer than three entries may be dropped and any entries in that class may be placed into the adjoining class closest to that entry's age.
9. Classes 13-15 must be accompanied by a certificate of pregnancy evaluation by a licensed verterinarian.
10. Females with calf at side will show in class 16 regardless to age. The calf may not be more than 240 days old when shown and calves more than 120 days old must be registered with the APA. Must be natural calf and cow must be wet.
11. Bulls in classes 29, 30, 31, 34, 35, 36, 37 must have a nose lead or ring.
12. Classes 34-37 must be accompanied by a satisfactory semen evaluation by a licensed veterinarian if offered for sale at the National Show.
13. Entry fees are not to exceed funds required to match premiums offered, plus fair entry fees.
14. Fitting:

No surgical alterations are permitted to the animals other than dehorning. No pumping or force filling with liquids, air, or any other substance. Tails are not to be "balled".

Class 46. Breeders Herd: A group of 4 animals bred by exhibitor, both sexes represented and at least two owned by exhibitor.

3. Premier Eshibitor, Premier Breeder and Premier Sire

Premier Exhibitor
For an exhibitor to be eligible, exhibitor must show at least 3 animals; both sexes represented, all owned by exhibitor. Award will be calculated on 6 highest ranking animals shown by exhibitor.

Premier Breeder
For a breeder to be eligible, at least 3 animals bred by exhibitor must be shown; both sexes represented; award will be calculated on their 6 highest-ranking animals bred by exhibitor. No requirement that breeder own or exhibit any of these animals.

Premier Sire
For a bull to be eligible, at least 3 offspring of the bull must be shown, both sexes represented. No requirement that the exhibitor own the bull. Award will be calculated on 6 highest ranking animals sired by each eligible bull.

Point System For Premier Exhibitor, Breeder and Sire
In the event of a tie, a seventh animal would be used for the tie breaker.

First Place - 6 points
Second Place - 5 points
Third Place - 4 points
Fourth Place - 3 points
Fifth Place - 2 points
Sixth Place - 1 point
